Asian Americans Advancing Justice Applauds Court of Appeals Ruling Refusing to Reinstate Travel Ban

Asian Americans Advancing Justice applauds the decision of the U.S. Court of Appeals for the Ninth Circuit to refuse to reinstate the Muslim ban.

WASHINGTON – Asian Americans Advancing Justice (Advancing Justice), an affiliation of five civil rights organizations, reacts to the ruling on the travel ban executive order issued by the United States Court of Appeals for the Ninth Circuit.

Asian Americans Advancing Justice stated the following:

“Asian Americans Advancing Justice applauds the decision of the U.S. Court of Appeals for the Ninth Circuit today. The Court, exercising independent judicial review, refused to reinstate President Trump’s executive order that banned immigrants and refugees from predominantly Muslim countries from entering the United States.

The Court rejected the Trump administration’s arguments that invoking national security concerns shielded the executive order from judicial scrutiny, noting that “it is beyond question that the federal judiciary retains authority to review the constitutionality of executive action.” The ruling affirms the important checks and balances in our constitutional system. Courts have the right and responsibility to review the lawfulness of the executive order, and we demand and expect courts to enforce the Constitution and protect all individuals from unconstitutional actions.”
